Anyone ever have to file internet fraud charges against an Ebay seller?

Bought something on Ebay on Halloween, seller said he shipped it on the 12th and should've had it last week, three weeks later, no part and seller doesn't communicate very well. Seller hasn't responded to the dispute I filed with Ebay on the 19th to refund me my money.
Its internet fraud. Just wondering if anyone else has gone through this.
Am I some how protected if I don't get my refund?

did you pay through Pay Pal? If so file your complaint through them...it freezes and/or deducts the money from him (assuming there is a + balance in his account) until the dispute is resolved.

I did file with both Ebay and Paypal. We'll see what happens.

That sucks Nick, I was a victim way back when E-bay was relatively new. I never got my item, it was insured, but the guy collected that too. I was out $$ and he was up in $$ twice the amount. If I ever run into him.......Well, lets just say- I'll never deal with anyone over the border again without proper feedback. Nick, don't forget to leave him the appropriate feedback.

A part arrived today. It was the same shape as the one I bought but the wrong one.

Refunded in full by the seller. Problem solved. I know this is an Olds site but if anyone ever needs Ford parts don't buy from hipofordshelbydetailing on Ebay.
